What are international codes of conduct for? The broad support for such codes masks fundamental differences about their purpose. Corporations see codes of conduct as regimes for regulating their relations with their suppliers in developing countries and—not least—to counter negative publicity. For labor and human rights activists, on the other hand, codes of conduct are levers for forcing positive change in global labor and environmental standards. Here I consider two areas typically covered by codes of conduct—wages and child labor—and identify (...) some of the dangers of using codes to force change. If low wages or child labor are the result of poverty, and can’t be fixed by enlightened corporate policies, then codes will at best leave the underlying problems untouched and at worst will aggravate them. I conclude that we should be cautious about using codes to force higher standards. (shrink)

In this collection, Harold Roth brings together the pivotal essays representing both the innovation and expertise that have marked his scholarship on Daoism for roughly the last twenty-five years. It is Roth's position that the foundations of classical Daoism rest upon a distinctive set of contemplative practices that he calls "inner training," which can be found in the Neiye, Laozi, and Zhuangzi, but also in a number of other classical texts of mixed traditions, including the Lushi chunqiu 呂氏春秋 and the (...) The Liezi is the forgotten classic of Daoism. Along with the Laozi (Daodejing) and the Zhuangzi, it's been considered a Daoist masterwork since the mid-eighth century, yet unlike those well-read works, the Liezi is little known and receives scant scholarly attention. Nevertheless, the Liezi is an important text that sheds valuable light on the early history of Daoism, particularly the formative period of sectarian Daoism. We do not know exactly what shape the original text took, but what remains is replete (...) with fantastic characters, whimsical tales, paradoxical aphorisms, and philosophically sophisticated reflection on the nature of the world and humanity's place within it. Ultimately, the Liezi sees the world as one of change and indeterminacy. Arguing for the Liezi's historical, philosophical, and literary significance, the contributors to this volume offer a fresh look at this text, using contemporary approaches and providing novel insights. At the 1927 Como conference Bohr spoke the famous words “It is wrong to think that the task of physics is to find out how nature is. Physics concerns what we can say about nature.” However, if the Copenhagen interpretation really adheres to this motto, why then is there this nagging feeling of conflict when comparing it with realist interpretations? Surely what one can say about nature should in a certain sense be interpretation independent. In this paper I take Bohr’s (...) motto seriously and develop a quantum logic that avoids assuming any form of realism as much as possible. To illustrate the non-triviality of this motto, a similar result is first derived for classical mechanics. It turns out that the logic for classical mechanics is a special case of the quantum logic thus derived. Some hints are provided as to how these logics are to be used in practical situations and finally, I discuss how some realist interpretations relate to these logics. (shrink)

In response to an accusation of having said something inappropriate, the accused may exploit the difference between the explicit contents of their utterance and its implicatures. Widely discussed in the pragmatics literature are those cases in which arguers accept accountability only for the explicit contents of what they said while denying commitment to the implicature. In this paper, we sketch a fuller picture of commitment denial. We do so, first, by including in our discussion not just denial of implicatures, but (...) also the mirror strategy of denying commitment to literal meaning and, second, by classifying strategies for commitment denial in terms of classical rhetorical status theory. In addition to providing a systematic categorization of our data, this approach offers some clues to determine when such a defence strategy is a reasonable one and when it is not. (shrink)

This paper queries why we are more reluctant to perform stem cell research on human than on nonhuman embryos, given their remarkable similarities together with the former's greater promise for addressing human illnesses. I begin by examining two leading arguments for prohibiting stem cell research on human embryos. The first type of argument suggests that we should not interfere with the potential for human life. This argument, advanced in different ways by both utilitarians and religious believers, inadequately grapples with the (...) moral complexities raised by current technologies, such as IVF and cloning. Moreover, it fails to address the significant adverse effects of human overpopulation to both human and nonhuman well-being. The second line of argument addressed here suggests that we are morally prohibited from "playing God." This argument overlooks the various ways in which we do—indeed, we must—make life and death decisions. Further, the argument rests on an undefended assumption that we are only prohibited from making such decisions with regard to human life, while remaining free to make such decisions with regard to animals without apparent moral qualms. On the contrary, I argue that, from a fully ethical Darwinian standpoint, we must treat both human and nonhuman life with respect. Far from requiring us to abstain from difficult moral decision making, an attitude of respect toward all life requires human willingness to take responsibility for making difficult—indeed, sometimes excruciating—moral decisions. Such strategies, ranging from epistemic to aesthetic practices, may be designed to validate and reinforce such knowledge, or, on the contrary, to discredit it. The interpretation of quantum mechanics has been a problem since its founding days. A large contribution to the discussion of possible interpretations of quantum mechanics is given by the so-called impossibility proofs for hidden variable models; models that allow a realist interpretation. In this thesis some of these proofs are discussed, like von Neumann’s Theorem, the Kochen-Specker Theorem and the Bell-inequalities. Some more recent developments are also investigated, like Meyer’s nullification of the Kochen-Specker Theorem, the MKC-models and Conway and Kochen’s (...) Free Will Theorem. This last one is taken to suggest that the problems that arise for certain interpretations of quantum mechanics are not limited to realist interpretations only, but also affect certain instrumentalist interpretations. It is argued that one may arrive at a more satisfying interpretation of quantum mechanics if one adopts a logic that seems more compatible with the instrumentalist viewpoint namely, intuitionistic logic. The motivations for adopting this form of logic rather than classical logic or quantum logic are linked to some of the philosophical ideas of Bohr. In particular a new interpretation of Bohr’s notion of complementarity is proposed. Finally some possibilities are explored for linking the intuitionistic interpretation of quantum mechanics to the mathematical formalism of the theory. (shrink)

Recently Cator and Landsman made a comparison between Bell’s Theorem and Conway and Kochen’s Strong Free Will Theorem. Their overall conclusion was that the latter is stronger in that it uses fewer assumptions, but also that it has two shortcomings. Firstly, no experimental test of the Conway–Kochen Theorem has been performed thus far, and, secondly, because the Conway–Kochen Theorem is strongly connected to the Kochen–Specker Theorem it may be susceptible to the finite precision loophole of Meyer, Kent and Clifton. In this article von Neumann’s proposal that in quantum mechanics projections can be seen as propositions is followed. However, the quantum logic derived by Birkhoff and von Neumann is rejected due to the failure of the law of distributivity. The options for constructing a distributive logic while adhering to von Neumann’s proposal are investigated. This is done by rejecting the converse of the proposal, namely, that propositions can always be seen as projections. This study examines the psychological contract between academics and their institutions during a time of great stress—the COVID-19 pandemic. Given that relationships between these parties have been found to be deteriorating prior to the pandemic, we believed it pertinent to explore how environmental changes brought about through lockdown conditions may have shifted the academic-institution relationship. Through a qualitative research design, our data is from 2029 women academics across 26 institutions of higher learning in South Africa. The major shifts in the (...) psychological contract were found to be workload and pressure, provision of resources, top-down communication, as well as trust and support. Whilst these shifts altered the transactional and interactional nature of the psychological contract, violation, rather than breach, occurred since the emotional responses of participants point to incongruence or misalignment of expectations between academics and their institutions during this time of crisis. We offer recommendations for rebuilding trust and negotiating the psychological contract to re-engage academics in the institution. (shrink)

Psychoanalysis knows two things at least. First, that all human endeavour and all human failure is imbued with anxiety, and that, therefore, to diagnose human endeavour, or to diagnose failure, is to locate the nature and origin of anxiety. And second, that anxiety itself amplifies the need to “diagnose” human being, and human beings. Psychoanalysts, in other words, know that for them to be able to do the work of psychoanalysis, they need to be (cultural) anthropologists first. In this contribution (...) an attempt is made to sketch out the broad outlines, and the deep anthropological backdrop, of a cultural undercurrent which has come to dominate Western culture in the first quarter of the twenty-first century. Building on Peter Sloterdijk’s work, and using the image of the ‘line of anxiety’ as a heuristic tool, we’ve named this cultural undercurrent radical bastardy, i.e. the aspiration to live as sovereign—absolutely sovereign-a life as possible. This cultural trend-which has a long history, and which many are now drawn to- is, however, shot through with anxiety. To live the life of an aspiring sovereign is to live a life in nagging anxiety. It is to live a life of unrelenting attempts to “diagnose” anything that even vaguely resembles law, or code, in order to avoid it, elude it, keep it at bay, or, if necessary, eradicate it. (shrink)

_This essay is a brief story of one comparative philosopher’s journey that led to an understanding of Daoism and how it can serve the world and not simply an indigenous Chinese minority community. __In Daoist contemplative experience, the practitioner does not gain some suprarational knowledge, but he/she is changed by the practices in which he/she engages. The person is remade, becoming like an infant or a newborn (_Daodejing 10, Zhuangzi 22_). The point is not that the experience leads to some (...) new cognitive truth about the world but rather what the experience itself consists of; that is, transformation. The Daoist practitioner acts/moves in a certain sort of way (i.e., as _wu-wei_), not according to something he/she knows, but by means of something he/she has become. Only a transformation of being can overcome the nature of humans to problematize life and tie themselves into knots. Daoism is designed to heal the central challenge of the will, and that is the ultimate remedy Daoist practice offers to global humanity. The way of Daoism does not rely on transcendent power or sources but on a person’s own ability to transform himself/herself by following its practices._. (shrink)

In this paper we adopt the hypothesis that languages are mechanisms for interaction, and that grammars encode the means by which such interaction may take place, by use of procedures that construct representations of meaning from strings of words uttered in context, and conversely strings of words are built up from representations of content in interaction with context. In a review of the systemic use of ellipsis in dialogue and associated split-utterance phenomena, we show how, in Dynamic Syntax, words give (...) rise to a range of procedures for the building of representations of the content of some utterance, which both speakers and hearers use. We then extend the discussion to take account of adjuncts, showing how they contribute to content construction both in single utterances and across speakers. The same mechanisms are then shown to underlie the building of inferential extensions of meaning in context, giving rise to the creation of the ad hoc concepts expressed by phrases or single words in relation to the utterance context and ultimately to the creation of metaphorical uses of language. Hedwig Conrad-Martius, the woman pioneer of the realistic phenomenological school, describes the reality to which her philosophizing is addressed as “totally non-material corporeality”. With this contradictory expression she seeks to affirm two foundational aspects regarding reality: the spatial that achieved material realization in real existents and the concealed non-spatial that is at the cradle of the establishing of reality and remains present behind its phenomenal and material appearing. This article focuses on three ontological elements in HCM’s idea of reality—“essence”, “abyss”, (...) and “self”—whose meaning both implies and raises the issue of the non-spatiality of Being in a complex manner. Moreover, the three seek the same objective of coming to terms with the force in real beings that will never ever be able to shine in its entirety. By means of philosophical explication of the mentioned elements and the illumination of the dialectic of each of them with the corresponding spatial aspects, this article demonstrates the evolution of HCM's understanding of the issue of spatiality that mirrors her metaphysics as a whole. This paper examines the Megg, Mogg and Owl stories of Simon Hanselmann, an Australian artist whose serialized comics both depict acts of contemporary roguery committed by a group of friends in an inner city sharehouse and test the generic limits of its own storytelling conventions, thereby becoming contemporary instances of “rogue texts.” The paper positions the adventures of Megg, a witch, Mogg, her familiar, Owl, their housemate, and associated characters including Booger and Werewolf Jones as contemporary variations of both the (...) Australian genre of grunge fiction and the broad international tradition of rogue literature. It shows how Megg, Mogg, Owl and their friends use the structure of the sharehouse to make their own rules, undertake illegal behaviour, and respond to the strictures of mainstream society, which alongside legal restrictions include normative restrictions on gender and behaviour. It shows the sharehouse as a response to their economic, as well as cultural and social conditions. The paper then shows how Megg and particularly Owl come up against the limitations of the permissiveness and apparent security of their “rogue” society, and respond by beginning to “go rogue” from the group. Meanwhile, the text itself, rather than advancing through time, goes over the same chronology and reinscribes it from new angles, becoming revisionist and re-creative, perhaps behaving roguishly against the affordances of episodic, vignette form. The paper argues that Simon Hanselmann’s Megg, Mogg and Owl comics can be understood as contemporary rogue texts, showing characters responding to social and generic limits and expressing them through a restless and innovative comics text. A well known logical loophole for Bell’s theorem is that it relies on setting independence: the assumption that the state of a system is independent of the settings of a measurement apparatus probing the system. In this paper the implications of rejecting this assumption are studied from an operationalist perspective. To this end a generalization of the ontic models framework is proposed that allows setting dependence. It is shown that within this framework Bell’s theorem reduces to the conclusion that no-signaling (...) requires randomness at the epistemic level even if the underlying ontology is taken to be deterministic. The ideas underlying the framework are further used to defend setting dependence against the charges of being incompatible with free will and scientific methodology. The paper ends however with the sketch of a new problem for setting dependence: a necessary gap between the ontic and the epistemic level that may prevent the formulation of a successful setting dependent theory.
